1. Acceptance of These Terms

Welcome to medicallienmgt.com (the "Site"), owned and operated by Medical Lien Management, Inc. ("Medical Lien Management," "MLM," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site, including any content, features, and forms made available through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms constitute a binding agreement between you and Medical Lien Management and remain in effect for as long as you use the Site, subject to the provisions that expressly survive termination as described in Section 18.

2. Description of the Site

The Site provides general information about Medical Lien Management's medical billing, revenue cycle management, workers' compensation billing, personal injury billing, med-legal billing, denial management, appeals, WCAB support, and related lien collection and resolution services (collectively, the "Services"). The Site is intended for healthcare providers, practice administrators, and other visitors interested in learning about or engaging our Services.

Engagement of our Services by a healthcare provider or organization is governed by a separate written services agreement, which will control the terms of that relationship. These Terms govern only your use of the Site itself.

3. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this requirement and, where you are submitting information on behalf of a practice or organization, that you are authorized to do so.

4. Privacy Policy

Our Privacy Policy, available at medicallienmgt.com, describes how we collect, use, and disclose information obtained through the Site and is incorporated into these Terms by reference.

5. Accounts and Client Portals

Certain features of our Services, such as reporting dashboards made available to engaged clients, may require registration or login credentials. If you are issued credentials to access such a feature, you are responsible for maintaining their confidentiality and for all activity that occurs under your credentials. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

6. Intellectual Property Rights

All content available on the Site, including text, graphics, logos, videos, podcast episodes, blog articles, software, and the selection and arrangement of that content (collectively, the "Content"), is owned by Medical Lien Management or its licensors and is protected by copyright, trademark, and other intellectual property laws. The names "Medical Lien Management" and "Jet Filing," along with our logos and other marks displayed on the Site, are trademarks of Medical Lien Management and may not be used without our prior written permission.

You may view and print Content for your own personal or internal business reference. You may not reproduce, distribute, modify, publicly display, publicly perform, republish, or otherwise exploit any Content for commercial purposes without our prior written consent.

7. Acceptable Use of the Site

When using the Site, you agree that you will not:

  1. Post or transmit unlawful, defamatory, threatening, abusive, or harassing content;
  2. Infringe the intellectual property rights, privacy rights, or other legal rights of Medical Lien Management or any third party;
  3. Violate any applicable local, state, federal, or international law or regulation;
  4. Attempt to interfere with, disrupt, or damage the Site or any related systems, including through the use of viruses, malware, denial-of-service attacks, or similar means;
  5. Use any automated means, including bots or scrapers, to access, monitor, or copy any portion of the Site without our prior written consent;
  6. Attempt to gain unauthorized access to any portion of the Site, other user accounts, or any connected systems or networks;
  7. Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  8. Submit false, misleading, or fraudulent information through any form on the Site;
  9. Collect or harvest information about other users or visitors without their consent; or
  10. Use the Site to advertise or solicit business unrelated to your inquiry, or assist any third party in doing any of the foregoing.

8. No Legal, Medical, or Financial Advice

Content on the Site, including information regarding lien filing deadlines, appeal procedures, regulatory requirements, or industry practices, is provided for general informational purposes only. It does not constitute legal, medical, financial, or professional advice, and it should not be relied upon as a substitute for consultation with a qualified attorney, healthcare professional, or other licensed advisor. Regulations governing medical liens, workers' compensation, and personal injury billing change over time and vary by circumstance, and you should confirm current requirements with appropriate counsel or the relevant regulatory body before acting on any information found on the Site.

9. Information You Submit to the Site

You are solely responsible for the accuracy and completeness of any information you submit through the Site's forms. As noted in our Privacy Policy, general contact and consultation forms are not intended for the submission of protected health information or other sensitive patient data. Please do not include such information in any form submission, email, or message sent through the Site. Information exchanged in connection with an active client engagement is handled through the secure channels established under the applicable services agreement.

10. Communications

By submitting your phone number or email address through the Site, you consent to be contacted by Medical Lien Management regarding your inquiry, including by phone, email, or text message. Message and data rates may apply. You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails, replying STOP to text messages, or contacting us using the information in Section 19. Opting out of marketing communications will not affect our ability to respond to a specific inquiry or request you have submitted.

11. Third-Party Links

The Site may contain links to third-party websites, including social media platforms, government agencies, and industry resources. These links are provided for your convenience only. Medical Lien Management does not control and is not responsible for the content, accuracy, or privacy practices of any linked third-party site, and inclusion of a link does not imply endorsement.

12. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MEDICAL LIEN MANAGEMENT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MEDICAL LIEN MANAGEMENT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND DOES NOT APPLY TO OBLIGATIONS ARISING UNDER A SEPARATE WRITTEN SERVICES AGREEMENT BETWEEN YOU AND MEDICAL LIEN MANAGEMENT, WHICH IS GOVERNED BY THE TERMS OF THAT AGREEMENT.

14. Indemnification

You agree to defend, indemnify, and hold harmless Medical Lien Management and its officers, directors, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.

15. Termination

We may suspend or terminate your access to all or part of the Site at any time, with or without cause and with or without notice, including where we believe you have violated these Terms. Termination of Site access does not affect the terms of any separate services agreement you may have with Medical Lien Management, which will continue to be governed by its own terms.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to the Site or these Terms will be governed by the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state courts located in Riverside County, California, or the United States District Court for the Central District of California, and you consent to the personal jurisdiction of those courts.

17. Modifications to These Terms

We may update these Terms from time to time by posting a revised version on the Site with an updated effective date. Your continued use of the Site after a revision becomes effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Medical Lien Management regarding your use of the Site and supersede any prior agreements on that subject.

Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms will not be construed as a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

No Third-Party Beneficiaries

These Terms do not confer any rights or remedies on any person or entity other than you and Medical Lien Management.

Survival

Sections 6, 8, 9, 12, 13, 14, and 16, along with any other provision that by its nature should survive, will remain in effect after termination of these Terms.
